Child Welfare Proposed Rules

 

The Department requests public input on the proposed rule changes described below. Click the links for more information.   • Amending child welfare rules (implements federal sex trafficking legislation and clarifies internal notification requirements for child abuse reports)

  • Amending rule about Department notification responsibilities when screening and assessing reports of child abuse or neglect

  • Amending rule about when the Department may waive the home study requirement for independent adoptions

  • Amending rule about guardianship permanency plans

    Last day to submit written comments: 7-22-16

  • Adopting and incorporating by reference the updated Behavior Rehabilitation Services (BRS) Rates Table

  • Child Welfare Rule Advisory Committee

     

    Before a Notice of Proposed Rulemaking is filed, the Department convenes a Rule Advisory Committee to review rule changes that may substantially impact the public. (See DHS-010-012) The purpose of a RAC is to provide an opportunity for stakeholders to participate in the rule development process. Invitees are selected to ensure that the interests of all persons impacted by proposed rule changes are represented. Although participation in the RAC is limited to invited participants, meetings are open to the public. For more information about RAC meetings, please contact the RAC Administrator.

  • The Department adopted temporary rules on July 1, 2016 to comply with SB 1515 (2016). Since then, the Department has listened to stakeholder feedback and continued to refine the temporary rules. Child-caring agencies, child welfare advocacy organizations, and legislators have been invited to participate in a RAC to review updated draft rules. RAC members may submit written questions and comments to kris.a.skaro@state.or.us until 8-31-16 at 5 p.m. RAC members may also provide comments in person at a RAC meeting on Monday, August 29, 2016. The agenda and links to the rules and notices of proposed rulemaking are available below. (Please note that although RAC participation is limited to invited members, the meeting is open to the public.)
