  1. OAR 309-102  "Handling Patient Mail in State Institutions"

    A public hearing will occur on January 27, 2012 at 10:00 AM in room 160 at
    500 Summer Street NE, E-86, Salem OR   97301-1118.  Temporary amendments to these rules can be accessed in #1 below.

  2. OAR 415-056  "Substance Abuse and Problem Gambling Prevention Programs" 

    These proposed new rules will replace the current 415-056 rules to accurately reflect
    and implement current  policies and practices and to incorporate problem gambling
    programs into the content.   

    A public hearing will occur on January 26, 2012 at 10:00 AM in room 137 D at 500 Summer Street NE E 86, Salem OR   97301-1118.

Latest Rule Activities

  1. OAR 309-102 "Handling Patient Mail in State Institutions"

    Temporary amendments to these rules were filed and effective on December 15, 2011, to correct an error in the text which inaccurately addressed the need to protect patients' confidentiality.

    A public hearing will occur on January 27, 2012 at 10:00 AM in room 160 at
    500 Summer Street NE E 86, Salem OR   97301-1118.

  2. OAR 309-090 "Forensic Mental Health Evaluators and Evaluations"

    These new temporary rules became effective on January 1, 2012. 

    These rules implement HB 3100 of the 2011 Oregon Laws, which relate to court-
    ordered evaluations of individuals whose competency to aid in their own defense or
    their capacity to have been criminally responsible are in question.

    These rules establish minimum standards for the certification of evaluators and will ensure forensic evaluations meet consistent quality standards.

  3. OAR 309-091 "State Hospital Admissions and Discharges"

    These new temporary rules became effective January 1, 2012, simultaneous to the temporary suspension of OAR 309-031-0205 through 309-031-0255 which addressed the same subject.

    These rules establish and define the criteria which support the proper management and utilization of services provided by the Oregon state hospital system, by limiting admissions to those most severely symptomatic individuals whose treatment and recovery needs cannot be met in a community treatment setting.

  4. OAR 309-092  "Oregon State Hospital Review Panel"

    These new temporary rules became effective on January 1, 2012 and implement Oregon Laws 2011, Chapter 708, Senate Bill 420.

    These rules establish the processes applicable to the Review Panel which, as designated by the Oregon Health Authority, acquires jurisdiction over certain offenders  who are found guilty except for insanity, while they remain in the state hospital.

  5. OAR 309-032-1500 through 309-032-1565  "Integrated Services and Supports"

    Temporary amendments to these rules became effective January 1, 2012.  This rule activity was in response to Oregon Laws 2011, Senate Bill 238, which required a review of administrative rules in search of excessive requirements and redundancies.

  6. OAR 309-016-0600 "Medicaid Payments For Rehabilitative Mental Health Services"

    Temporary amendments to these rules became effective January 1, 2012.  This rule activity was in response to Oregon Laws 2011, Senate Bill 238, which required a review of administrative rules in search of excessive requirements and redundancies.

  7. OAR 309-035-0100 and 0105 "Residential Treatment Facilities"
    OAR 309-035-0250 and 0260 "Residential Treatment Homes"
    OAR 309-040-0300 and 0305 "Adult Foster Homes"
               
    These three pair of rules are temporarily amended and became effective on December 5, 2011.  The action occurred so that the definitions for "abuse" and "mistreatment" coincide with identical language changes to the administrative rules for the Office of Investigation and Training, the office which investigates abuse allegations.

  8. OAR 309-014-0300 "Central Oregon Health Council and Regional Health Improvement Plan"

    These temporary rules relate to the implementation of Chapter 418, Oregon Laws 2011, Sections 13 through 20, which call for the creation of the Central Oregon Health Council and the implementation of the Central Oregon Health Improvement Plan.

    These temporary rules became effective on September 1, 2011.
