It clarifies that the right of the state to recover against a community spouse's annuity for the institutionalized spouse's medical costs is not limited to the amount the state paid for the institutionalized spouse's medical costs as of the date of death.
If the annuity is set up to only reimburse assistance paid through the date of death, this would not be a qualifying annuity.
